Use of services provided by Ozark Fiber, LLC or the affiliate providing services in your area (collectively, “Ozark Fiber”) (the “Services”) is subject to this Acceptable Use Policy (“AUP”), together with the applicable service agreement. This AUP applies to residential and business Services unless a separate written agreement expressly provides otherwise. Copyright-specific procedures are governed by Ozark Fiber’s Copyright Policy, and collection, use and disclosure of customer information are governed by its Privacy Policies and applicable law.

1) Lawful Purposes Only. You shall use the Services for lawful purposes only. You shall not post or transmit through the Services any material (including any message or series of messages) that violates or infringes on the rights of others (including copyright), that is unlawful, threatening, abusive, harassing, defamatory, invasive of privacy or publicity rights, unlawfully obscene, or that encourages conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any law.

2) Child Sexual Abuse Material; Mandatory Reporting. You shall not use the Services to create, store, upload, post, transmit, or distribute child sexual abuse material (“CSAM”), or to entice, coerce, or traffic a minor for sexual purposes. Ozark Fiber has zero tolerance for this conduct. Upon obtaining actual knowledge of facts or circumstances triggering a reporting obligation under 18 U.S.C. § 2258A, Ozark Fiber will report to the National Center for Missing & Exploited Children’s CyberTipline as soon as reasonably possible and preserve related information as required by law. Ozark Fiber may also make lawful disclosures to law enforcement and immediately suspend or terminate Services associated with this conduct, subject to applicable law, preservation obligations, and lawful law-enforcement requests. This provision does not impose a duty to monitor or affirmatively search for such activity beyond applicable legal requirements.

3) No Resale; Hosting and Network Sharing. You may not resell the Services or use them to operate as an ISP without Ozark Fiber’s express written approval. You may not use any router or network extender to provide the Services to persons or entities at another service address without that approval. On residential Services plans, you may not run dedicated equipment or servers to provide content or services to the public outside your Local Area Network (“LAN”), including gaming servers, e-mail hosting, web hosting, file-sharing servers, and public proxy services, unless Ozark Fiber expressly approves the use in writing. Business hosting or similar use must be permitted by the applicable plan or expressly approved in writing. These restrictions do not prohibit ordinary use of cloud-based applications, personal gaming sessions, or secure remote access to your own devices, provided the use complies with the applicable service agreement and the remaining provisions of this AUP.

4) Copyrighted Material. The Services provide access to copyrighted material, trademarks and other proprietary information. Except as otherwise permitted under copyright law, no copying, redistribution, publication or commercial exploitation of downloaded material is permitted without the consent of the copyright owner.

5) Postings. You shall not upload, post or otherwise make available through the Services any material protected by copyright, trademark or other proprietary right unless you own the applicable rights, have the rights holder’s permission, or the use is otherwise permitted by law, including fair use where applicable.

6) Privacy and Customer Information. Ozark Fiber’s collection, use and disclosure of customer information, including customer lists and aggregate information, are governed by its Privacy Policies and applicable law. This AUP does not provide additional consent to share customer information or override privacy choices or protections for Customer Proprietary Network Information (“CPNI”) or text-messaging opt-in data and consent.

7) Enforcement of Acceptable Use Restrictions. Ozark Fiber may assert and enforce the provisions of this AUP directly or through authorized service providers acting on its behalf. This AUP does not grant third parties an independent contractual right to enforce these provisions.

8) Additional Operating Policies and Conditions of Use:

a) You shall not impersonate another person or entity, falsely claim an affiliation, or use another person’s name or credentials without authority to deceive or defraud. This restriction does not prohibit the lawful use of pseudonyms.

b) You shall not participate or use your Services in any way to make fraudulent offers of products, items or services.

c) You shall not mass post unsolicited or duplicative messages to accounts, services or servers in a manner that constitutes spam, message bombing, or disruption of those systems.

d) You shall not post or e-mail scams such as “make-money-fast” schemes or pyramid or chain letters. Nor shall you engage in these activities using the service of another ISP while channeling such activities through the Services or using the Services as a mail drop for responses.

e) You shall not use the Services to send unsolicited advertising, promotional material or other forms of unwanted solicitation, except in areas on-line specifically designated for such communications.

f) You shall not interfere with Ozark Fiber’s ability to provide Services to others, including by using bandwidth or other network resources in a manner that materially disrupts or degrades network availability or other users’ legitimate use of the Services.

g) You shall not knowingly transfer, post or transmit files that contain viruses, worms, “Trojan Horses” or any other contaminating or destructive features.

h) You shall not export software or technical information in violation of United States export control laws.

i) You shall not perform any activity on the Services that constitutes a criminal offense.

j) You shall not use the Services in any manner that threatens or causes damage to Ozark Fiber’s network or another network, including by launching or facilitating denial-of-service attacks, distributing malicious code, engaging in or attempting unauthorized Domain Name System (“DNS”) cache poisoning, or exploiting network vulnerabilities without authorization.

k) See Section 3 (No Resale; Hosting and Network Sharing) for restrictions on resale, hosting, network extenders and routers. If you use a wireless network or WiFi at your service address, you must establish and use a secure password or comparable safeguards to restrict access to authorized users consistent with Section 3.

l) You shall not attempt to access Ozark Fiber’s non-public data, employee accounts, computers, telephones, administrative accounts, network equipment, management networks, Virtual Private Networks (“VPNs”), management interfaces, storage devices, servers, or Application Programming Interfaces (“APIs”) not intended for general use, without authorization.

m) You shall not attempt to circumvent access controls or access any other device, network, or computer system that you are not authorized to use.

n) You shall not port scan, probe, or fingerprint any device or network without authorization.

o) You shall not alter, manipulate, forge, or spoof Media Access Control (“MAC”) addresses, Internet Protocol (“IP”) addresses, or message headers for purposes of fraud, unauthorized access, impersonation, evasion of security or abuse controls, or other unlawful activity. This restriction does not prohibit lawful privacy or security technologies that do not otherwise violate this AUP or the applicable service agreement.

p) You shall not use the Services to collect lists of e-mail addresses, usernames, account numbers, other identities, or Personally Identifiable Information (“PII”) without required authorization or in violation of applicable law.

q) You may access Ozark Fiber’s Customer Premises Equipment (“CPE”) management interfaces and management functions for the CPE associated with your Services using only the interfaces and applications provided by Ozark Fiber.

r) You shall not access the Services or configure equipment to access the Services using a public static Internet Protocol (“IP”) address unless the Services plan expressly permits such use or Ozark Fiber has given express written approval. Unless Ozark Fiber expressly authorizes a different configuration in writing, an authorized public static IPv4 address must be obtained through a Dynamic Host Configuration Protocol (“DHCP”) lease reservation provisioned by Ozark Fiber and must not be manually assigned or hard-coded on the Internet-facing (wide area network or “WAN”) interface of your router or other device. Any authorized IPv6 addresses or prefixes must be obtained and configured using the method specified by Ozark Fiber. These restrictions do not prohibit private static IP addresses within your LAN, subject to the equipment-management restrictions in Section 8(t) and the other provisions of this AUP.

s) If Ozark Fiber notifies you that a device on your network appears to be compromised or is being used to attack, disrupt, or gain unauthorized access to other networks or devices (for example, as part of a botnet), you must promptly secure, update, or disconnect that device from the Services. Ozark Fiber may immediately restrict or suspend the Services where reasonably necessary to protect its network or others, including before notifying you of a security threat. Any restoration of Services is subject to the applicable service agreement.

t) You shall not, without Ozark Fiber’s authorization, upgrade, replace or modify software or firmware on Ozark Fiber-provided or Ozark Fiber-managed Customer Premises Equipment (“CPE”), or alter, disable or interfere with settings or functions required for Ozark Fiber’s provisioning, management, monitoring, security or maintenance of that CPE. This restriction does not prohibit changes to customer-accessible settings that Ozark Fiber makes available for customer use, such as Wi-Fi names and passwords, through the authorized interfaces or applications described in Section 8(q), provided those changes do not disable or interfere with the functions described above.

u) Unless the applicable Services plan permits otherwise or Ozark Fiber gives express written approval, each Internet-service connection is limited to one authorized Internet-facing (WAN) Media Access Control (“MAC”) address at a time and one public Internet Protocol version 4 (“IPv4”) address. These limits apply to the connection to Ozark Fiber’s network, not to the number of devices or private IP addresses on your LAN with Network Address Translation (“NAT”) enabled, and do not restrict IPv6 addresses or prefixes that Ozark Fiber authorizes for your connection. You shall not obtain or attempt to obtain additional WAN address assignments or DHCP leases beyond those authorized for your connection. Ozark Fiber may reject, revoke, block or remove unauthorized or excess DHCP leases or address assignments, temporarily or permanently and without prior notice, subject to applicable law and the applicable service agreement.

9) Monitoring Measures. To the extent permitted by applicable law and consistent with its Privacy Policies, Ozark Fiber reserves the right to monitor or investigate network traffic and use of the Services where reasonably necessary for troubleshooting, network management or security, investigating suspected abuse, enforcing this AUP, or legal compliance. This provision does not create a general obligation to monitor customer content or activity.

10) Violations of Acceptable Use Restrictions. Violations of this Acceptable Use Policy may result in warnings, restrictions, suspension or termination of Services. Action is subject to applicable law, the applicable service agreement and, for copyright matters, the Copyright Policy; immediate action may be taken where permitted without a prior warning or cure period.

11) Investigations. Subject to applicable law and, for copyright matters, the Copyright Policy, in its discretion, Ozark Fiber may initiate an investigation and, in order to prevent further possible unauthorized activity, may suspend access to Service to the individual account in question. Confirmation of violations may result in termination of the individual account and, in cases of unlawful activity, lawful referral to law enforcement.

12) Enforcement Disclaimer. By publishing these acceptable use restrictions, Ozark Fiber does not assume a general obligation to any customer or third party to monitor or investigate activity or to take enforcement action regarding every alleged violation. To the maximum extent permitted by law, Ozark Fiber disclaims liability for a failure to monitor, investigate or enforce these restrictions, and retains discretion concerning enforcement, subject to applicable law, the applicable service agreement and its Copyright Policy. Ozark Fiber has adopted and reasonably implements a policy that provides for termination, in appropriate circumstances, of subscribers and account holders who are repeat copyright infringers. Copyright notices, user-hosted-content takedown and counter-notification procedures, and repeat-infringer enforcement are governed by the Copyright Policy, which controls over conflicting copyright-related provisions of this AUP. Copyright notices must be submitted to the designated Copyright Agent using the contact information in the Copyright Policy. The sole designated email address is dmca@ozarkfiber.com; individual officer and employee email accounts are not designated intake channels. The Copyright Policy’s provisions on misdirected notices and reservation of rights apply. Ozark Fiber does not undertake general monitoring for copyright infringement and accommodates standard technical measures as described in the Copyright Policy and 17 U.S.C. § 512(i). Nothing in this disclaimer overrides applicable law or the conditions for any applicable DMCA safe harbor.

13) Changes to this Policy. Ozark Fiber may update this AUP from time to time, subject to applicable law and the notice and effectiveness provisions of the applicable service agreement.
